Contributions to national and international marital property law 2021

20 years of intercantonal notarial cooperation

For the occasion of its 20th anniversary, the swisNot notary network is publishing articles in a main field of notaries and public officials, namely matrimonial property regimes. Professor Andrea Bonomi is the scientific editor and we thank him warmly for his excellent collaboration. These “Mélanges” contain, on the one hand, academic contributions relating to the European Regulation on Matrimonial Property Regimes, presented in the framework of the 3rd International Property Law Day on 16 September 2021, co-organised by the Centre for Comparative, European and International Law (CDCEI) of the University of Lausanne and swisNot. On the other hand, it contains several texts from practitioners which provide useful additions concerning matrimonial property regimes in Spain and Germany, as well as leads on the protection of the family business by marriage contract in the participation in acquired property regime, judicial considerations relating to matrimonial property regimes and highlighting of differences in the tax treatment of donations and successions.

Contributions to commercial law

15 years of intercantonal cooperation

On the occasion of its 15th anniversary, the swisNot notarial network is publishing nine high-profile contributions on current commercial law issues. The authors deal in their own language with questions relating to commercial register practices, the concept of “close relatives” in the context of so-called “qualified transactions”, the refusal of approval in the case of the transfer by succession of registered shares with restrictions on transferability, the “liquidation privilege” in the case of the resale of securities, quorums, capital reduction in connection with company reorganisation, the influence of the FATF on our legislation and on notarial activity, tax issues in connection with real estate profits and finally the first lessons to be drawn from the Ordinance on Unfair Remuneration.

10 years of Intercantonal Notarial Cooperation

10 ans de collaboration notariale intercantonale

On the occasion of the 10th anniversary of their network, the swisNot members have decided to publish various contributions on current issues of everyday notarial practice. The authors, each in his or her own language, deal with questions relating to electronic authentic instruments, inventories in the event of fiduciary substitution, the donor’s right of return, the need to conclude a contract for work and services in authentic form when it is linked to a real estate sales contract, asset management and estate planning in an international context.
