La vente en viager peut \u00eatre une solution int\u00e9ressante. Mais de quoi parle-t-on exactement ?<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-luqzcy5s-b47dfe1a688933ed30d1ec2fd5442982 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Le viager occup\u00e9, soit la forme de viager la plus largement r\u00e9pandue, repose sur le principe suivant : le vendeur c\u00e8de sa propri\u00e9t\u00e9 \u00e0 un acqu\u00e9reur, mais conserve le droit d\u2019occuper son bien-fonds jusqu\u2019\u00e0 la fin de ses jours. En contrepartie, l\u2019acheteur s\u2019engage \u00e0 verser un capital en esp\u00e8ces, ainsi qu\u2019une rente r\u00e9guli\u00e8re en faveur du vendeur, et ce jusqu\u2019\u00e0 son d\u00e9c\u00e8s.<\/p>\n<p>Un des avantages majeurs du viager est qu\u2019il permet au vendeur, lequel doit en pratique \u00eatre \u00e2g\u00e9 de 70 ans au moins, de maintenir un niveau de vie confortable pendant sa retraite, sans avoir \u00e0 d\u00e9m\u00e9nager. De l\u2019autre c\u00f4t\u00e9, cela permet \u00e0 l\u2019acheteur, lequel doit en pratique avoir au minimum vingt ans de moins que le vendeur, d\u2019acqu\u00e9rir un bien immobilier \u00e0 un co\u00fbt potentiellement inf\u00e9rieur \u00e0 celui du march\u00e9, avec la possibilit\u00e9 de r\u00e9aliser un investissement immobilier int\u00e9ressant, selon la dur\u00e9e de vie du vendeur.<\/p>\n<p>Les modalit\u00e9s de paiement d\u2019une vente en viager occup\u00e9 comprennent donc le versement d\u2019un capital unique en esp\u00e8ces correspondant en principe \u00e0 une fourchette comprise en 20 et 30 % de la valeur du march\u00e9 du bien vendu ; la constitution d\u2019une rente viag\u00e8re sur la t\u00eate du vendeur ; la constitution d\u2019un droit d\u2019usage en faveur du vendeur.<\/p>\n<p><strong>Les risques<\/strong><\/p>\n<p>Bien que tr\u00e8s attractive en th\u00e9orie, la vente en viager n\u2019est pas exempte de d\u00e9fis et de risques potentiels. Les parties doivent en effet prendre en compte diff\u00e9rentes variables, telles que la long\u00e9vit\u00e9 du vendeur, les co\u00fbts d\u2019entretien du bien vendu, la fluctuation du march\u00e9 immobilier, de m\u00eame que les diff\u00e9rentes cons\u00e9quences fiscales, ainsi que les risques encourus en cas d\u2019insolvabilit\u00e9 de l\u2019une ou l\u2019autre des parties.<\/p>\n<p>Parmi les aspects cruciaux de la n\u00e9gociation d\u2019un tel type de contrat, figurent notamment la d\u00e9termination de la rente, laquelle d\u00e9pend principalement de facteurs impr\u00e9visibles tels que l\u2019esp\u00e9rance de vie du vendeur et les conditions du march\u00e9 immobilier, de m\u00eame que le choix du droit d\u2019usage en faveur du vendeur. Ce dernier peut prendre la forme d\u2019un droit d\u2019habitation ou d\u2019un usufruit. \u00c0 cet effet, il sera notamment important de prendre en consid\u00e9ration le fait que l\u2019exercice de l\u2019usufruit est cessible, ce qui n\u2019est en revanche pas le cas du droit d\u2019habitation, quand bien m\u00eame le vendeur serait dans l\u2019impossibilit\u00e9 de rester domicili\u00e9 dans le bien-fonds vendu.
