Et, lorsqu\u2019il s\u2019agit d\u2019un bien flambant neuf, l\u2019op\u00e9ration se fait souvent par le biais d\u2019une vente sur plan ou cl\u00e9s en main.<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-l8uc3jyw-11ad6cb482c2a53c1f5d729ff431de65 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Concr\u00e8tement, l\u2019acheteur va payer des acomptes au fur et \u00e0 mesure de l\u2019avancement des travaux.<\/p>\n<p>Le premier acompte consiste \u00e0 payer le terrain (et \u00e9ventuellement une partie des travaux d\u00e9j\u00e0 ex\u00e9cut\u00e9s), ce qui correspond souvent aux fonds propres demand\u00e9s par une banque pour un achat \u00abstandard\u00bb. Les acomptes suivants sont ensuite vers\u00e9s selon les diverses \u00e9tapes de la construction. L\u2019\u00e9tablissement bancaire interviendra dans le paiement des acomptes, mais il faut \u00e9videmment avoir l\u2019accord de principe quant au financement au moment de la signature du contrat. Ces paiements par acomptes permettent d\u2019avoir un certain contr\u00f4le et une certaine protection pour l\u2019acheteur. Il est toutefois prudent de pr\u00e9voir dans le contrat que, si la construction n\u2019avance plus, l\u2019acheteur peut arr\u00eater de payer les acomptes ou peut \u00e9galement pr\u00e9voir des p\u00e9nalit\u00e9s en cas de retard dans la livraison de l\u2019appartement ou de la maison.<\/p>\n<p>Il faut donc \u00eatre attentif au contrat qui va \u00eatre sign\u00e9 avec le vendeur, respectivement le constructeur-promoteur-entrepreneur. En effet, il s\u2019agit d\u2019une \u00e9tape cruciale pour \u00e9viter les mauvaises surprises.<\/p>\n<p><strong>Deux variantes<\/strong><\/p>\n<p><strong><em>Premi\u00e8re variante<\/em><\/strong> : le vendeur-promoteur vend le terrain \u00e0 l\u2019acheteur et signe, ensuite avec lui, un contrat d\u2019entreprise ind\u00e9pendant pour la construction. Dans ce cas, un acte de vente authentique pour le terrain (ou la quote-part de terrain pour un appartement) est sign\u00e9 avec le vendeur-promoteur, lequel est coupl\u00e9 avec un contrat d\u2019entreprise sous simple forme \u00e9crite qui est sign\u00e9 avec le constructeur, lequel peut \u00eatre le vendeur-promoteur lui-m\u00eame, mais aussi une tierce personne ou entit\u00e9 (autre entrepreneur) qui s\u2019occupe de la construction.<\/p>\n<p>L\u2019avantage principal de cette premi\u00e8re variante consiste \u00e0 \u00eatre directement inscrite au Registre foncier comme propri\u00e9taire, ce qui peut rassurer l\u2019acheteur par rapport \u00e0 sa premi\u00e8re \u00abmise de fonds\u00bb. Cependant, des inconv\u00e9nients peuvent appara\u00eetre, \u00e0 savoir que le promoteur-vendeur n\u2019assumera plus aucune responsabilit\u00e9 dans la phase de la construction, notamment si un contrat est sign\u00e9 avec une entreprise tierce, laquelle pourrait, par exemple, faire faillite; le propri\u00e9taire pourrait donc se retrouver avec une construction inachev\u00e9e, sans possibilit\u00e9 de se retourner contre le vendeur-promoteur, respectivement l\u2019entrepreneur. En outre, le contrat d\u2019entreprise sous forme \u00e9crite est souvent r\u00e9dig\u00e9 par l\u2019entrepreneur et impos\u00e9 au futur propri\u00e9taire.<\/p>\n<p><em><strong>Deuxi\u00e8me variante<\/strong><\/em> : le vendeur-promoteur signe un contrat de vente sur plan ou cl\u00e9s en main avec l\u2019acheteur qui comprend les deux aspects, soit l\u2019achat du terrain (vente) et la construction (contrat d\u2019entreprise ou descriptif de construction). Les parties sont alors li\u00e9es par un seul et unique contrat sous forme authentique, lequel offre une plus grande valeur juridique. Dans ce cas, la composante \u00ab entreprise\u00bb qui y est int\u00e9gr\u00e9e peut \u00eatre \u00abcontr\u00f4l\u00e9e\u00bb par un homme de loi, le notaire en l\u2019occurrence, dans le but d\u2019assurer un \u00e9quilibre entre les parties. L\u00e0 encore, l\u2019acheteur peut exiger d\u2019\u00eatre inscrit comme propri\u00e9taire d\u00e8s le paiement du premier acompte.<\/p>\n<p>En achetant sur plan, le ou les contrats initiaux sign\u00e9s sont donc fondamentaux; l\u2019acheteur doit s\u2019entourer de professionnels et bien analyser les prestations qui seront pr\u00e9vues pour son futur logement, tout en pr\u00e9voyant des \u00ab garde-fous\u00bb en cas de probl\u00e8mes (en particulier la garantie pour les d\u00e9fauts). Il faut \u00e9galement bien se renseigner sur l\u2019entit\u00e9 qui r\u00e9alisera la construction. Enfin, il faut \u00abgarder un \u0153il\u00bb sur le chantier pour s\u2019assurer que tout se passe bien !<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\"
