En revanche, le droit d\u2019habitation ne peut s\u2019exercer que sur une habitation, c&#8217;est-\u00e0-dire un local dans lequel on peut vivre et dormir, que ce soit une maison ou un appartement. Nous nous limiterons ici \u00e0 une maison, qui peut \u00eatre objet de l\u2019un et de l\u2019autre. La diff\u00e9rence fondamentale r\u00e9side dans le fait que l\u2019usufruitier peut c\u00e9der l\u2019usage de la maison en la louant et en tirer un loyer. Cependant, le b\u00e9n\u00e9ficiaire du droit d\u2019habitation est oblig\u00e9 d\u2019habiter la maison lui-m\u00eame, avec sa famille. Il ne peut pas la louer. Et, s\u2019il d\u00e9m\u00e9nage dans un EMS, son droit prendra fin.<\/p>\n<p style=\"text-align: justify;\">Les diff\u00e9rences portent aussi sur la charge de l\u2019entretien et des frais. Tant l\u2019usufruitier que le b\u00e9n\u00e9ficiaire d\u2019un droit d\u2019habitation ont l\u2019obligation de \u00abconserver la substance de la chose\u00bb, c\u2019est-\u00e0-dire de maintenir l\u2019\u00e9tat de la maison dans lequel ils l\u2019ont re\u00e7ue. Ils ont un devoir de nettoyage habituel et de r\u00e9parations courantes (laver les vitres et les lani\u00e8res de stores, r\u00e9parer un robinet qui coule, etc.) et paient l\u2019eau, le gaz et l\u2019\u00e9lectricit\u00e9, un peu comme un locataire. L\u2019\u00e9tendue de leur devoir d\u2019entretien n\u2019est cependant pas le m\u00eame.<\/p>\n<p style=\"text-align: justify;\">L\u2019usufruitier, lui qui a une jouissance plus \u00e9tendue, a un devoir de nettoyage habituel ainsi que de r\u00e9parations courantes et, en plus, un devoir d\u2019entretien r\u00e9gulier (r\u00e9vision de la citerne, pon\u00e7age des parquets, etc.). Il devra aussi payer les int\u00e9r\u00eats hypoth\u00e9caires, mais pas l\u2019amortissement de la dette. Il n\u2019aura cependant pas \u00e0 payer la r\u00e9novation du toit ou des fa\u00e7ades. Si des travaux plus importants sont n\u00e9cessaires, il avisera le propri\u00e9taire qui devra les assumer. De son c\u00f4t\u00e9, le b\u00e9n\u00e9ficiaire du droit d\u2019habitation, parce qu\u2019il a des pr\u00e9rogatives beaucoup plus limit\u00e9es, a \u00e9galement des obligations all\u00e9g\u00e9es. Il doit utiliser la maison avec soin. Il n\u2019est responsable que de l\u2019entretien et des r\u00e9parations ordinaires.<\/p>\n<p style=\"text-align: justify;\">Il y a des diff\u00e9rences non n\u00e9gligeables dans le domaine fiscal \u00e9galement.<\/p>\n<p style=\"text-align: justify;\">Dans le cas de l\u2019usufruit, tous les imp\u00f4ts sont pay\u00e9s par l\u2019usufruitier: imp\u00f4t sur le revenu (valeur locative), imp\u00f4t sur la fortune, imp\u00f4t foncier. Dans le cas du droit d\u2019habitation, le propri\u00e9taire doit s\u2019acquitter des imp\u00f4ts sur la fortune et de l\u2019imp\u00f4t foncier, le b\u00e9n\u00e9ficiaire du droit ne paie que l\u2019imp\u00f4t sur le revenu (valeur locative).Enfin, s\u2018il s\u2019agit de demander des prestations compl\u00e9mentaires, il convient de se renseigner. Chaque cas \u00e9tant particulier, il n\u2019est pas possible d\u2019\u00e9tablir une r\u00e8gle g\u00e9n\u00e9rale.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\"
