Elle souhaiterait faire des travaux de r\u00e9novation dans l\u2019un des appartements pour s\u2019y installer. Mais comment proc\u00e9der et quelles sont les r\u00e8gles pr\u00e9vues par la loi?<\/p>\n<p style=\"text-align: justify;\">En premier lieu, Anita devra identifier le genre de propri\u00e9t\u00e9 collective auquel la maison est soumise. En effet, la propri\u00e9t\u00e9 \u00e0 plusieurs peut prendre diff\u00e9rentes formes juridiques, comme la propri\u00e9t\u00e9 commune et la copropri\u00e9t\u00e9. En voici les grands principes.<\/p>\n<p style=\"text-align: justify;\"><strong>PROPRI\u00c9T\u00c9 COMMUNE<\/strong><br \/>\nL\u2019hoirie, form\u00e9e par l\u2019ensemble des h\u00e9ritiers du d\u00e9funt, est l\u2019exemple le plus courant de propri\u00e9t\u00e9 commune. A l\u2019ouverture d\u2019une succession, les h\u00e9ritiers deviennent automatiquement propri\u00e9taires en commun de tous les biens que poss\u00e9dait le d\u00e9funt. Dans ce r\u00e9gime, il n\u2019y a pas de parts distinctes dont un h\u00e9ritier pourrait librement disposer. Les d\u00e9cisions concernant les biens h\u00e9rit\u00e9s se prennent \u00e0 l\u2019unanimit\u00e9. L\u2019hoirie prend fin au moment du partage de la succession.<\/p>\n<p style=\"text-align: justify;\">Dans le cas d\u2019Anita, si elle avait h\u00e9rit\u00e9 de la maison avec sa tante et sa cousine, il s\u2019agirait, jusqu\u2019au partage de la succession, de d\u00e9cider ensemble de l\u2019usage de chacun des appartements et des travaux de r\u00e9novation \u00e0 entreprendre.<\/p>\n<p style=\"text-align: justify;\"><strong>COPROPRI\u00c9T\u00c9<\/strong><br \/>\nLa copropri\u00e9t\u00e9 est le r\u00e9gime auquel les couples recourent le plus souvent lors d\u2019un achat immobilier. La copropri\u00e9t\u00e9 se distingue de la propri\u00e9t\u00e9 commune dans la mesure o\u00f9 chaque copropri\u00e9taire d\u00e9tient une part de copropri\u00e9t\u00e9 d\u00e9termin\u00e9e. Les parts de copropri\u00e9t\u00e9 s\u2019expriment en fraction du bien (1\/2, 1\/3, etc.) et correspondent fr\u00e9quemment au montant investi dans celui-ci. Chaque copropri\u00e9taire peut vendre sa part sans le consentement des autres copropri\u00e9taires. Cependant, dans ce cas, il doit d\u2019abord la proposer aux autres copropri\u00e9taires qui peuvent, s\u2019ils le souhaitent, racheter la part de copropri\u00e9t\u00e9. Cette facult\u00e9 s\u2019appelle le \u00abdroit de pr\u00e9emption\u00bb. Le r\u00e9gime de la copropri\u00e9t\u00e9 ne r\u00e8gle pas les questions concernant la r\u00e9partition de l\u2019usage du bien entre les copropri\u00e9taires, les d\u00e9cisions y relatives devant se prendre d\u2019entente entre eux.<\/p>\n<p style=\"text-align: justify;\"><strong>UNE ALTERNATIVE<\/strong><br \/>\nSous le r\u00e9gime de la copropri\u00e9t\u00e9, Anita, sa tante et sa cousine seraient toutes les trois copropri\u00e9taires de la maison, et donc des trois appartements. Ainsi, l\u2019utilisation des trois appartements et les d\u00e9cisions concernant ceux-ci devraient \u00eatre prises d\u2019entente entre elles. Toutefois, pour rem\u00e9dier \u00e0 cette situation, elles pourraient adopter un r\u00e8glement de copropri\u00e9t\u00e9 traitant de ces questions et le faire mentionner au Registre foncier. Il convient de noter que la loi pr\u00e9voit \u00e9galement un r\u00e9gime particulier de copropri\u00e9t\u00e9, appel\u00e9 \u00abpropri\u00e9t\u00e9 par \u00e9tages\u00bb ou \u00abPPE\u00bb. Sa particularit\u00e9 consiste \u00e0 accorder, \u00e0 chaque copropri\u00e9taire, un droit d\u2019usage exclusif sur une partie d\u00e9termin\u00e9e du b\u00e2timent (l\u2019appartement de 3 pi\u00e8ces au 1er \u00e9tage par exemple).<\/p>\n<p style=\"text-align: justify;\">Dans le cas d\u2019Anita, la PPE lui permettrait de profiter seule d\u2019un des trois appartements et de le r\u00e9nover \u00e0 son go\u00fbt, sans devoir obtenir le consentement de sa tante ou de sa cousine.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\"
