La PPE est probablement faite pour vous. En voici les principales caract\u00e9ristiques.<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-luqx7tyt-c404d7100d9ccc33691b20c405c1d83e '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>La propri\u00e9t\u00e9 par \u00e9tages (PPE) est une forme de propri\u00e9t\u00e9 collective qui conf\u00e8re, \u00e0 chaque copropri\u00e9taire, un droit exclusif sur une partie de b\u00e2timent appel\u00e9e \u00ab partie priv\u00e9e \u00bb ou \u00ab lot de PPE \u00bb.<\/p>\n<p>Les parties priv\u00e9es (logements, locaux commerciaux) et les parties communes (hall d\u2019entr\u00e9e, escaliers, sous-sol, etc.) sont d\u00e9finies par un g\u00e9om\u00e8tre dans un cahier de r\u00e9partition des locaux. Ce document d\u00e9termine les surfaces des lots de PPE et fixe le nombre de milli\u00e8mes attribu\u00e9s \u00e0 ceux-ci. Les milli\u00e8mes correspondent \u00e0 la quote-part de chaque lot par rapport \u00e0 la valeur totale du b\u00e2timent. Ils d\u00e9pendent essentiellement de la surface du lot et d\u00e9terminent l\u2019\u00e9tendue des droits et des devoirs de chaque copropri\u00e9taire comme dit ci-apr\u00e8s.<\/p>\n<p>Une fois le cahier de r\u00e9partition des locaux \u00e9tabli par le g\u00e9om\u00e8tre, le(s) propri\u00e9taire(s) se rend(ent) chez le notaire pour mettre au point, puis signer l\u2019acte de mise en PPE de la parcelle. Les servitudes utiles ou n\u00e9cessaires au projet sont constitu\u00e9es aux termes de cet acte. Il peut s\u2019agir, par exemple, de rattacher un jardin, une cave ou une place de stationnement \u00e0 un appartement d\u00e9termin\u00e9. Les parties adoptent \u00e9galement un r\u00e8glement ayant pour but de fixer les r\u00e8gles relatives \u00e0 l\u2019administration et \u00e0 l\u2019utilisation de l\u2019immeuble. Ce r\u00e8glement peut contenir des r\u00e8gles sp\u00e9cifiques \u00e0 l\u2019immeuble (r\u00e9f\u00e9rence de la couleur des toiles des stores, autorisation ou non de faire des barbecues sur les balcons, etc.). L\u2019acte constitutif de la PPE peut enfin accorder, \u00e0 chaque copropri\u00e9taire, un droit de pr\u00e9emption qui s\u2019exerce en cas de vente d\u2019un lot de PPE.<\/p>\n<p>Une fois la PPE constitu\u00e9e, les copropri\u00e9taires se r\u00e9unissent en assembl\u00e9e au moins une fois par an. L\u2019assembl\u00e9e prend toutes les d\u00e9cisions n\u00e9cessaires au bon fonctionnement de la copropri\u00e9t\u00e9. Les d\u00e9cisions font l\u2019objet d\u2019un vote dont les r\u00e8gles varient selon leur importance.<\/p>\n<p>Une d\u00e9cision concernant l\u2019ex\u00e9cution de travaux d\u2019entretien, de r\u00e9paration ou de r\u00e9fection sera, par exemple, prise \u00e0 la majorit\u00e9 simple (plus de la moiti\u00e9 des milli\u00e8mes). Pour permettre l\u2019ex\u00e9cution de travaux destin\u00e9s \u00e0 augmenter la valeur de l\u2019immeuble, il faudra que la d\u00e9cision recueille une majorit\u00e9 double (plus de la moiti\u00e9 des milli\u00e8mes et plus de la moiti\u00e9 des propri\u00e9taires). Il faudra enfin une d\u00e9cision prise \u00e0 l\u2019unanimit\u00e9 pour d\u00e9cider de l\u2019ex\u00e9cution de travaux destin\u00e9s exclusivement \u00e0 embellir le b\u00e2timent ou encore pour transformer une partie commune en une partie priv\u00e9e.<\/p>\n<p>L\u2019assembl\u00e9e des propri\u00e9taires nomme un administrateur qui peut \u00eatre un copropri\u00e9taire ou un tiers (r\u00e9gie par exemple). L\u2019administrateur a pour mission de g\u00e9rer la copropri\u00e9t\u00e9 conform\u00e9ment aux d\u00e9cisions de l\u2019assembl\u00e9e des propri\u00e9taires. Il veille notamment \u00e0 la conservation de l\u2019immeuble en faisant ex\u00e9cuter les travaux n\u00e9cessaires et s\u2019assure du bon fonctionnement des installations communes. Les charges et frais communs (entretien des parties communes, primes d\u2019assurance couvrant le b\u00e2timent, salaire du concierge, etc.) sont r\u00e9partis par l\u2019administrateur entre les copropri\u00e9taires. Cette r\u00e9partition se fait proportionnellement aux milli\u00e8mes de chaque lot de PPE.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
