Tr\u00e8s attach\u00e9s \u00e0 la r\u00e9gion dans laquelle ils avaient l\u2019habitude de passer leurs vacances, les 4 enfants ont convenu, de mani\u00e8re informelle, que chacun d\u2019eux pourrait utiliser librement l\u2019un des \u00e9tages de la maison. Le fr\u00e8re de Jean a aujourd\u2019hui pris ses distances d\u2019avec la fratrie et souhaite vendre son \u00e9tage. Jean et ses s\u0153urs sont pr\u00e9occup\u00e9s, ils craignent que l\u2019\u00e9tage de leur fr\u00e8re puisse \u00eatre transf\u00e9r\u00e9 au premier venu.<\/p>\n<p>En r\u00e9alit\u00e9, les 4 enfants constituent la communaut\u00e9 h\u00e9r\u00e9ditaire de leur papa et, tant que celle-ci n\u2019a pas \u00e9t\u00e9 effectivement dissoute (par un partage successoral inscrit au Registre foncier), ils sont propri\u00e9taires en main commune et ne peuvent, selon la loi, en disposer que d\u2019un commun accord entre tous. Jean et ses s\u0153urs peuvent donc \u00eatre rassur\u00e9s, leur fr\u00e8re ne peut rien entreprendre sans leur accord et ils auront, au surplus, la possibilit\u00e9 de reprendre l\u2019\u00e9tage dans le cadre du partage successoral.<\/p>\n<p>Marie est copropri\u00e9taire de la maison dans laquelle elle vit. Elle souhaite vendre, a trouv\u00e9 des acheteurs et s\u2019est adress\u00e9e \u00e0 son notaire pour pouvoir signer le contrat de vente. Surprise, son notaire lui a indiqu\u00e9 que, avant de pouvoir vendre, il fallait s\u2019assurer que le copropri\u00e9taire ne fasse pas usage de son droit de pr\u00e9emption. Marie est \u00e9tonn\u00e9e, une de ses amies a vendu son appartement sans que cette question ne se pose. En v\u00e9rit\u00e9, le Code civil attribue aux copropri\u00e9taires un droit de pr\u00e9emption l\u00e9gal leur permettant, en cas de vente par l\u2019un des copropri\u00e9taires de se porter acqu\u00e9reur en lieu et place du tiers acqu\u00e9reur, aux m\u00eames conditions. Ce droit pourra \u00eatre restreint ou supprim\u00e9 par le biais d\u2019un acte notari\u00e9 pass\u00e9 entre les copropri\u00e9taires et annot\u00e9 au Registre foncier. C\u2019est donc \u00e0 juste titre que le notaire de Marie l\u2019a avertie de ces modalit\u00e9s.<\/p>\n<p>Anthony et Alice, jeunes mari\u00e9s, souhaitent acqu\u00e9rir un bien immobilier qui doit leur servir de domicile. Comme Alice dispose des fonds suffisants pour cette acquisition et qu\u2019Anthony devra prochainement investir un certain nombre de ses fonds propres dans son entreprise, les \u00e9poux envisagent qu\u2019Alice acqui\u00e8re leur maison seule et en soit l\u2019unique propri\u00e9taire. Anthony n\u2019est pas totalement rassur\u00e9, il a peur qu\u2019Alice puisse disposer \u00e0 sa guise de l\u2019immeuble. En r\u00e9alit\u00e9, le Code civil suisse pr\u00e9voit un certain nombre de dispositions servant \u00e0 la protection du logement commun des \u00e9poux et prescrit en particulier qu\u2019un \u00e9poux ne peut sans le consentement expr\u00e8s de son conjoint, ni ali\u00e9ner la maison familiale, ni restreindre les droits dont d\u00e9pend le logement de la famille. Anthony peut donc \u00eatre rassur\u00e9, tant que le bien acquis par Alice sert de logement de la famille, son \u00e9pouse ne pourra en disposer
