Le 1er janvier 2023, il conna\u00eetra toutefois une de ses rares \u00e9volutions.<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-ct7eyc-83c69cbc6d8b0e02a0a20eb88dc23d6a '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Une \u00e9volution, mais pas de r\u00e9volution cependant : les grands principes du droit successoral suisse, notamment protecteurs, sont pr\u00e9serv\u00e9s. Les modifications attendues apportent toutefois un suppl\u00e9ment de souplesse.<\/p>\n<p>Sans entrer dans le d\u00e9tail, le point saillant de ces changements concerne l\u2019augmentation de la part dont vous pouvez librement disposer dans la planification de votre succession. Cette part, qu\u2019on nomme \u00ab quotit\u00e9 disponible \u00bb, est pr\u00e9cieuse. Elle permet, en effet, de favoriser un membre de votre famille (par exemple pour faciliter une transmission d\u2019entreprise), de gratifier un proche m\u00e9ritant ou de soutenir une \u0153uvre caritative, culturelle ou religieuse.<\/p>\n<p>Actuellement, si vous avez un conjoint et des enfants, la quotit\u00e9 disponible est de 37,5% de votre succession; si vous avez des enfants, mais que vous n\u2019\u00eates pas mari\u00e9\u2022e, elle est de 25 % et, si vous \u00eates c\u00e9libataire et sans descendance, elle est de 50 % (en pr\u00e9sence de vos parents) ou de 100 % (en leur absence); en d\u2019autres termes, dans cette toute derni\u00e8re hypoth\u00e8se, vous pouvez laisser l\u2019entier de votre patrimoine \u00e0 qui bon vous semble.<\/p>\n<p>Avec le nouveau droit, les pourcentages indiqu\u00e9s ci-dessus augmentent. Ainsi, dans la premi\u00e8re situation, la quotit\u00e9 disponible sera de 50 %,dans la deuxi\u00e8me de 50 % \u00e9galement, et dans la troisi\u00e8me \u2014 en toute hypoth\u00e8se \u2014 de 100 % (la part r\u00e9serv\u00e9e des m\u00e8re et p\u00e8re dispara\u00eet).<\/p>\n<p><strong>Attention \u00e0 la formulation<\/strong><\/p>\n<p>Il se peut que vous ayez d\u00e9j\u00e0 mis vos affaires en ordre, c\u2019est-\u00e0-dire consign\u00e9 (dans une des formes reconnues) vos volont\u00e9s. Si tel est le cas, se pose alors la question de savoir quel sera sur elles l\u2019effet de ces nouveaut\u00e9s. Selon un avis largement partag\u00e9, dans la mesure o\u00f9 vous n\u2019avez pas chiffr\u00e9 les parts, mais choisi une expression du type : \u00ab J\u2019attribue la plus grande part possible \u00e0 \u2026 \u00bb ou \u00ab J\u2019octroie la quotit\u00e9 disponible \u00e0 \u2026 \u00bb), les nouvelles fractions s\u2019appliqueront d\u00e8s le 1er janvier 2023, favorisant un peu plus encore le b\u00e9n\u00e9ficiaire de vos souhaits. A l\u2019inverse, si vos dispositions d\u00e9terminent les parts (par exemple \u00ab J\u2019attribue 37,5 % de ma succession \u00e0 \u2026 \u00bb), ces pr\u00e9cisions seront en principe retenues. Il faut souligner que vous pouvez d\u2019ores et d\u00e9j\u00e0 exprimer vos choix de telle sorte \u00e0 b\u00e9n\u00e9ficier, d\u00e8s l\u2019an prochain, de la plus grande libert\u00e9 qu\u2019offrira le droit nouveau.<\/p>\n<p>D\u2019une mani\u00e8re g\u00e9n\u00e9rale, il est recommand\u00e9 de relire r\u00e9guli\u00e8rement votre testament. En effet, l\u2019\u00e9coulement du temps estompe naturellement le souvenir de son contenu. Il est ainsi possible que, \u00e0 la suite d\u2019une modification de votre situation familiale ou patrimoniale, ou de vos affinit\u00e9s, vos \u00e9crits ne soient plus en ad\u00e9quation. Ce conseil est d\u2019autant plus vrai \u00e0 l\u2019approche d\u2019un changement l\u00e9gislatif.
