Que se passe-t-il une fois la condition r\u00e9alis\u00e9e? Les parties \u00e0 l\u2019acte sont-elles oblig\u00e9es de s\u2019ex\u00e9cuter ?<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-jwjigdnc-7c012b9db97d3f2a08f039a35230ac91 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p style=\"text-align: justify;\">Jean est propri\u00e9taire d\u2019une parcelle de 5000 m\u00e8tres carr\u00e9s sur laquelle se trouve sa maison et un grand jardin. Souhaitant se faire plaisir et voyager lors de sa retraite, il a d\u00e9cid\u00e9 de vendre une partie de son jardin. Jean a trouv\u00e9 un acqu\u00e9reur d\u2019accord d\u2019acheter une surface de 2000 m\u00e8tres carr\u00e9s de sa parcelle, mais, uniquement, s\u2019il est assur\u00e9 de pouvoir y construire sa propre villa.<\/p>\n<p style=\"text-align: justify;\">L\u2019acheteur appelle son notaire, lequel lui explique qu\u2019il y a lieu de signer une promesse de vente et d\u2019achat bas\u00e9e sur un plan de g\u00e9om\u00e8tre, afin de d\u00e9terminer la surface de 2000 m\u00e8tres carr\u00e9s qui sera \u00abpromise-vendue \u00bb. L\u2019ex\u00e9cution de la promesse de vente sera conditionn\u00e9e \u00e0 l\u2019obtention d\u2019un permis de construire la villa. La promesse de vente et d\u2019achat est ainsi sign\u00e9e chez le notaire avec le versement d\u2019un acompte de 10% du prix de la vente (cet acompte demeurera consign\u00e9 chez le notaire jusqu\u2019au jour du transfert immobilier). Une fois l\u2019acte sign\u00e9, un dossier de mise \u00e0 l\u2019enqu\u00eate pour la construction de la future villa est d\u00e9pos\u00e9 aupr\u00e8s de la Commune concern\u00e9e. Aucune opposition n\u2019\u00e9tant faite et aucun recours d\u00e9pos\u00e9, le permis devient d\u00e9finitif et ex\u00e9cutoire.<\/p>\n<p style=\"text-align: justify;\"><strong>Surprise!<\/strong><br \/>\nAinsi, la condition pr\u00e9vue dans la promesse de vente et d\u2019achat est r\u00e9alis\u00e9e. Un nouveau rendez-vous est fix\u00e9 chez le notaire afin de signer l\u2019acte de vente d\u00e9finitif qui ex\u00e9cute la promesse. Cet acte devra \u00e9galement pr\u00e9voir la division de la parcelle, afin de pouvoir vendre uniquement la surface de 2000 m\u00e8tres carr\u00e9s promise-vendue. Le jour de la signature chez le notaire, l\u2019acheteur ne se pr\u00e9sente pas! Il informe simplement les parties qu\u2019il a, entre-temps, trouv\u00e9 la villa de ses r\u00eaves d\u00e9j\u00e0 construite sur une autre parcelle et qu\u2019il ne veut ainsi plus acheter la parcelle promise-vendue.<\/p>\n<p style=\"text-align: justify;\">Jean, totalement stup\u00e9fait, demande au notaire si l\u2019acheteur est en droit de faire cela. Le notaire lui r\u00e9pond bien entendu que\u2026 non! Une promesse de vente et d\u2019achat a pour but de lier les parties afin que le vendeur soit oblig\u00e9 de vendre et l\u2019acheteur oblig\u00e9 d\u2019acheter. Cela signifie qu\u2019aucune des parties ne peut se d\u00e9lier de ses obligations, et ce m\u00eame en proposant \u00e0 l\u2019autre de lui payer un montant en contrepartie, \u00e0 moins que cela n\u2019ait \u00e9t\u00e9 express\u00e9ment pr\u00e9vu dans l\u2019acte notari\u00e9 (ce montant, qui s\u2019appelle un \u00abd\u00e9dit\u00bb, n\u2019est que tr\u00e8s rarement pr\u00e9vu). En revanche, il est usuel de pr\u00e9voir dans l\u2019acte notari\u00e9 l\u2019introduction d\u2019une \u00abclause p\u00e9nale\u00bb afin de r\u00e9gler un cas de d\u00e9faillance de l\u2019une ou l\u2019autre des parties. Cette clause mentionne en g\u00e9n\u00e9ral deux possibilit\u00e9s. La partie non d\u00e9faillante peut choisir entre poursuivre l\u2019ex\u00e9cution du contrat en demandant des dommages-int\u00e9r\u00eats moratoires ou, alors simplement, renoncer \u00e0 l\u2019ex\u00e9cution du contrat en exigeant, en lieu et place, le paiement d\u2019un montant \u00e0 titre de \u00abpeine conventionnelle\u00bb, montant qui correspond usuellement aux 10% du prix de la vente. Jean demande ainsi au notaire de faire constater la \u00abd\u00e9faillance\u00bb de l\u2019acheteur. Il exigera ensuite que le montant de l\u2019acompte consign\u00e9 chez le notaire lui soit vers\u00e9 \u00e0 titre de peine conventionnelle.<\/p>\n<\/div><\/section><\/p><\/div>\n<style
