Arriv\u00e9e \u00e0 l\u2019\u00e2ge de 82 ans, elle se demande comment continuer \u00e0 soutenir cette cause apr\u00e8s son d\u00e9c\u00e8s. Peut-elle simplement l\u2019indiquer dans son testament\u2009? Et pourrait-elle m\u00eame cr\u00e9er sa propre fondation\u2009?<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-mu3rnk5a-6a62233a46cd89ab9523e1b0fdb15962 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p><span data-contrast=\"none\">D\u00e9signer une fondation existante comme h\u00e9riti\u00e8re ou l\u00e9gataire, c\u2019est la solution la plus simple et la plus fr\u00e9quente. Dans son testament,\u00a0Madame Steiner peut ainsi pr\u00e9voir qu\u2019une partie de sa succession revienne \u00e0 la fondation qu\u2019elle soutient depuis des ann\u00e9es. Comme pour un proche, elle peut\u00a0l\u2019instituer\u00a0comme h\u00e9riti\u00e8re (la fondation participe alors \u00e0 l\u2019ensemble de la succession) ou comme l\u00e9gataire\u00a0(elle\u00a0re\u00e7oit un montant ou un bien d\u00e9termin\u00e9).<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Il faut toutefois rappeler un point essentiel\u2009: les droits des h\u00e9ritiers r\u00e9servataires doivent toujours \u00eatre respect\u00e9s. Autrement dit, si des personnes prot\u00e9g\u00e9es par la loi (par exemple, des enfants ou un conjoint) existent, une fondation ne pourra recevoir une succession que dans les limites permises.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><strong>Cr\u00e9er une fondation au d\u00e9c\u00e8s\u2009?<span data-ccp-props=\"{\">\u00a0<\/span><\/strong><\/p>\n<p><span data-contrast=\"none\">Madame Steiner pourrait \u00e9galement d\u00e9cider que, le jour de son d\u00e9c\u00e8s, naisse une fondation d\u00e9di\u00e9e \u00e0 la recherche contre le cancer, poursuivant ainsi ce qui lui tient \u00e0 c\u0153ur.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Une telle fondation \u00ab\u2009successorale\u2009\u00bb doit toutefois r\u00e9pondre \u00e0 plusieurs exigences\u2009:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">&#8211; disposer d\u2019un patrimoine adapt\u00e9 au but choisi\u2009;<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">&#8211; poursuivre un objectif d\u2019int\u00e9r\u00eat public\u2009;<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">&#8211; \u00eatre suffisamment d\u00e9finie dans le testament (but,\u00a0\u00a0<\/span> <span data-contrast=\"none\">\u00a0\u00a0 dotation, organisation minimale).<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Le montant n\u00e9cessaire n\u2019est donc pas uniforme\u2009: il d\u00e9pend du projet envisag\u00e9 et de la mani\u00e8re dont la fondation devra fonctionner. Un notaire peut aider \u00e0 d\u00e9terminer si l\u2019id\u00e9e est r\u00e9aliste et comment la structurer.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><strong>Et les fondations de famille\u2009?<span data-ccp-props=\"{\">\u00a0<\/span><\/strong><\/p>\n<p><span data-contrast=\"none\">\u00c9voquons enfin un troisi\u00e8me cas, parfois m\u00e9connu. Un neveu de Madame Steiner souffre d\u2019une forme rare de cancer n\u00e9cessitant des traitements co\u00fbteux et un accompagnement sp\u00e9cialis\u00e9. Elle se demande si une fondation pourrait contribuer durablement \u00e0 son\u00a0soutien. La r\u00e9ponse est\u2009: oui, mais dans un cadre tr\u00e8s strict. Les fondations de famille sont autoris\u00e9es\u00a0uniquement lorsqu\u2019elles visent \u00e0 aider les membres de la famille dans certaines situations pr\u00e9cises\u2009: maladie, \u00e9tudes, soutien ponctuel en cas de difficult\u00e9s. Elles ne peuvent pas servir \u00e0 g\u00e9rer un patrimoine familial sur plusieurs g\u00e9n\u00e9rations, ni contourner les r\u00e8gles successorales. Dans un cas comme celui du neveu de<\/span><span data-ccp-props=\"{\">\u00a0<\/span><span data-contrast=\"none\">Madame Steiner, une telle fondation pourrait n\u00e9anmoins \u00eatre pertinente, si
