Es handelt sich um eine neue Art von Auftrag, mit welchem eine handlungsf\u00e4hige Person f\u00fcr den Fall der eigenen Urteilsunf\u00e4higkeit vorsorgen und eine Drittperson mit der Erledigung ihrer Gesch\u00e4fte beauftragen kann.<\/p>\n<p>In einem derartigen Fall sehen sich die betroffenen Personen mit nicht sehr beliebten Verwaltungsverfahren konfrontiert (Beistand, Vormundschaft, &#8230;).<\/p>\n<p>Seit anfangs Jahr ist es dank dem Vorsorgeauftrag im Hinblick auf den Verlust der eigenen Urteilsf\u00e4higkeit m\u00f6glich sein, einen Familienangeh\u00f6rigen oder eine nahestehende Person mit der Erledigung der eigenen Gesch\u00e4fte zu beauftragen.<\/p>\n<p>Um die G\u00fcltigkeit eines solchen Auftrages zu gew\u00e4hrleisten, wird allen Interessenten empfohlen, sich an einen Vertrauensnotar zwecks Vornahme der notariellen Beurkundung des Vorsorgeauftrages zu wenden.<\/p>\n<p>Die Patientenverf\u00fcgung stellt eine weitere Neuigkeit dar, die seit anfangs 2013 gilt. Mit dieser kann jede Person ihren Willen f\u00fcr den Fall \u00e4ussern, dass sie infolge Krankheit oder Unfall dazu nicht mehr in der Lage w\u00e4re. Dabei geht es prim\u00e4r um Willens\u00e4usserungen gegen\u00fcber den \u00c4rzten oder dem Spitalpersonal, insbesondere im Zusammenhang mit medizinischen Behandlungen, die man gegebenenfalls w\u00fcnscht oder eben nicht w\u00fcnscht. M\u00f6glich ist weiter die Regelung eines Besuchsrechts oder die Bezeichnung einer Person, die im Zweifelsfall betreffend die (Nicht-)Anwen-dung einer Behandlung zu konsultieren ist.<br \/>\nDie nachstehenden Erl\u00e4uterungen betreffen ausschliesslich den Vorsorgeauftrag.<\/p>\n<h3><strong>M\u00f6glicher Inhalt<\/strong><\/h3>\n<p>Gegenstand des Vorsorgeauftrages kann die Personensorge, die Verm\u00f6genssorge sowie die Vertretung im Rechtsverkehr mit Dritten sein. Der Auftraggeber hat daf\u00fcr zu sorgen, dass die anvertrauten Aufgaben gut umschrieben werden. Der Bevollm\u00e4chtigte ist in Bezug auf allf\u00e4llige bei der Erledigung des Auftrags geltende Auflagen und Bedingungen ausreichend zu instruieren und aufzukl\u00e4ren.<\/p>\n<h3><strong>Der Auftraggeber<\/strong><\/h3>\n<p>Der Auftraggeber kann einen oder mehrere Bevollm\u00e4chtigte(n) (nat\u00fcrliche und\/oder juristische Personen) bezeichnen. Wie im Falle eines ordentlichen Mandates bedarf der Auftrag der Zustimmung des Bevollm\u00e4chtigten. Dem Auftraggeber wird empfohlen, f\u00fcr den Fall der Ablehnung, Urteilsunf\u00e4higkeit oder auch der K\u00fcndigung durch den Bevollm\u00e4chtigten, entsprechende Vorkehrungen zu treffen (Ernennung eines Ersatzbeauftragten).<\/p>\n<h3><strong>G\u00fcltigkeit<\/strong><\/h3>\n<p>Sobald die Erwachsenenschutzbeh\u00f6rde erf\u00e4hrt, dass eine Person urteilsunf\u00e4hig geworden ist, erkundigt sie sich beim Zivilstandsamt dar\u00fcber, ob die betroffene Person einen Vorsorgeauftrag erteilt hat. Gegebenenfalls pr\u00fcft sie, ob der Auftrag g\u00fcltig errichtet wurde, ob die Voraussetzungen f\u00fcr seine Wirksamkeit erf\u00fcllt sind, ob weitere Massnahmen des Erwachsenenschutzes erforderlich sind und ob der Bevollm\u00e4chtigte den Auftrag annimmt und auch f\u00e4hig ist, ihn zu erf\u00fcllen.<\/p>\n<h3><strong>Erf\u00fcllung<\/strong><\/h3>\n<p>Der Bevollm\u00e4chtigte hat die auftraggebende Person im Rahmen des Vorsorgeauftrags zu vertreten und die ihm aufgetragenen Aufgaben sorgf\u00e4ltig wahrzunehmen. Dies gilt insbesondere bei der Verm\u00f6genssorge. Im Fall eines Gesch\u00e4fts, das \u00fcber den Auftrag hinausgeht oder bei einer Interessenskollision zwischen dem Auftraggeber und dem Bevollm\u00e4chtigten, ist Letztgenannter verpflichtet, die Erwachsenschutzbeh\u00f6rde sofort zu benachrichtigen, damit diese t\u00e4tig werden kann.<\/p>\n<h3><strong>Entsch\u00e4digung<\/strong><\/h3>\n<p>Um Unklarheiten zu vermeiden, wird dem Auftraggeber empfohlen, die Entsch\u00e4digungsgrunds\u00e4tze des Bevollm\u00e4chtigten im Vorsorgeauftrag zu regeln. Die Entsch\u00e4digung wird selbstverst\u00e4ndlich der auftraggebenden Person belastet.<\/p>\n<h3><strong>Widerruf<\/strong><\/h3>\n<p>Solange die auftraggebende Person urteilsf\u00e4hig ist &#8211; oder falls sie es wieder wird -, kann sie den Vorsorgeauftrag jederzeit in einer der Formen, die f\u00fcr die Errichtung vorgeschrieben sind, oder durch Vernichtung, widerrufen. Zu beachten ist, dass der urspr\u00fcngliche Auftrag durch Errichtung eines neuen Vorsorgeauftrages automatisch ersetzt wird, sofern er nicht zweifelsfrei eine blosse Erg\u00e4nzung darstellt.<\/p>\n<h3><strong>K\u00fcndigung<\/strong><\/h3>\n<p>Die beauftragte Person kann den Vorsorgeauftrag aus wichtigen Gr\u00fcnden mit sofortiger Wirkung oder ohne Angabe von Gr\u00fcnden mit
