Die Bestimmung eines Willensvollstreckers ist insbesondere dann angebracht, wenn die Nachlassliquidation wegen dem Ausmass oder der Beschaffenheit der Aktiven oder wegen m\u00f6glicher Unstimmigkeiten zwischen den Erben voraussichtlich mit Problemen verbunden ist. Nachfolgend einige Bemerkungen zum Willensvollstrecker, zu seinen Rechten und Pflichten sowie zu seiner Haftung.<\/p>\n<h3><strong>Zur Person des Willensvollstreckers<\/strong><\/h3>\n<p>Die Bezeichnung eines Willensvollstreckers ist immer eine letztwillige Verf\u00fcgung; sie kann in einem Testament oder einem Erbvertrag enthalten sein.<\/p>\n<p>Als Willensvollstrecker kommen sowohl nat\u00fcrliche Personen (eine Frau, ein Mann, mehrere Personen, der beurkundende Notar), wie juristische Personen (eine Gesellschaft) in Frage. In der Regel handelt es sich um eine Vertrauensperson, welche selbst\u00e4ndig handelt.<\/p>\n<p>Nach Er\u00f6ffnung des Testaments durch die zust\u00e4ndige Instanz hat der Willensvollstrecker 14 Tage Zeit, um sich zu entscheiden, ob er das Mandat annehmen will. L\u00e4sst er sich nicht vernehmen, so gilt dies als Annahme des Mandats. Er kann sich diesfalls von der zust\u00e4ndigen Instanz eine Best\u00e4tigung \u00fcber seine Qualit\u00e4t als Willensvollstrecker ausstellen lassen.<\/p>\n<h3><strong>Die Rechte und Pflichten des Willensvollstreckers<\/strong><\/h3>\n<p>Die Rechte und Pflichten des Willensvollstreckers werden in erster Linie durch den Testator definiert. Wo nicht, werden die Befugnisse des Willensvollstreckers vom Gesetzt festgesetzt. In jedem Fall hat der Willensvollstrecker eine weitgehende Verwaltungs- und Verf\u00fcgungsmacht.<\/p>\n<p>Die Rechte und Pflichten des Willensvollstreckers entstehen mit der Annahme des Mandats. Sobald die ihm zugedachte Mission erledigt ist, fallen die Vollmachten des Willensvollstreckers dahin. Oberste Pflicht des Willensvollstreckers ist es, dem Willen des Testators Nachachtung zu verschaffen.<\/p>\n<p>Bei Amtsantritt hat der Willensvollstrecker ein Nachlassinventar zu errichten, sofern ein solches nicht bereits besteht.<\/p>\n<p>Der Willensvollstrecker verwaltet den Nachlass. Er bezahlt die ausstehenden Schulden und richtet die vorgesehenen Verm\u00e4chtnisse aus, sorgt f\u00fcr die Einhaltung der Auflagen und bereitet die Teilung vor. Er wird allenfalls sogar veranlasst sein, eine dem Willen des Verstorbenen entsprechende Stiftung zu errichten. Um Schulden des Verstorbenen oder der Erbschaft zu bezahlen bzw. um Verm\u00e4chtnisse ausrichten zu k\u00f6nnen, kann er sogar ohne Zustimmung der Erben Immobilien verkaufen. Soweit dies im Hinblick auf seine Mission zweckm\u00e4ssig erscheint, kann er auch Verpflichtungen begr\u00fcnden oder beenden (z.B. Darlehen k\u00fcndigen, Vertr\u00e4ge abschliessen, Betreibung einleiten), Nachlassaktiven verkaufen oder mit einem Pfandrecht belasten, Forderungen abtreten usw.<\/p>\n<p>Der Willensvollstrecker kann, soweit dies im Hinblick auf die Mandatserf\u00fcllung n\u00f6tig ist, auch in Gerichtsverfahren mitwirken. Er allein kann in Betreibungsverfahren Partei sein. Hingegen hat er keine Parteistellung in Erbschafts- oder Herabsetzungsklagen.<\/p>\n<p>Im Zusammenhang mit der Erbteilung sind die Vollmachten des Willensvollstreckers begrenzt. Er kann die Teilung vorbereiten, den Erben einen Vorschlag unterbreiten, aber er hat keine Erm\u00e4chtigung zur selbst\u00e4ndigen Durchf\u00fchrung der Teilung. Sind sich die Erben einig, so hat er ihren Willen anzuerkennen. Kommt es zu keiner Einigung, so kann der Willensvollstrecker auf sein Mandat verzichten oder warten, bis ein Erbe die Teilungsklage einreicht.<\/p>\n<p>Die Honorierung des Willensvollstreckers kann vom Testator bereits vorgesehen sein (z.B. indem er dem Willensvollstrecker ein Verm\u00e4chtnis aussetzt). In jedem Fall hat der Willensvollstrecker Anspruch auf eine angemessene Verg\u00fctung. Sie bemisst sich nach der \u00fcbernommenen Verantwortung, dem Arbeitsaufwand sowie der Gr\u00f6sse des Nachlasses und der angefallenen Auslagen.<\/p>\n<h3><strong>Die Haftung und die Aufsicht<\/strong><\/h3>\n<p>Der Willensvollstrecker haftet gegen\u00fcber den Erben f\u00fcr die den Umst\u00e4nden entsprechende Sorgfalt bei der Erledigung seiner Aufgabe. Allerdings sind die den Erben zur Verf\u00fcgung stehenden Kontroll- und Druckmittel limitiert. Die f\u00fcr den Mandatsvertrag vorgesehenen Regeln sind analog anwendbar.<\/p>\n<p>Die Beh\u00f6rde ihrerseits \u00fcbt keine permanente Kontrolle \u00fcber den Willensvollstrecker aus.
