Le couple n\u2019a pas eu d\u2019enfant. Elle a h\u00e9rit\u00e9 d\u2019un petit immeuble de dix appartements dont ils occupaient celui du dernier \u00e9tage, c\u00f4t\u00e9 ouest. Jeanne dispose aujourd\u2019hui de quelques \u00e9conomies, touche une rente AVS, un modeste deuxi\u00e8me pilier et profite des loyers des neufs appartements occup\u00e9s par des locataires. Mais la gestion de l\u2019immeuble qu\u2019elle assume encore seule devient astreignante.<\/p>\n<p>Effectivement, les d\u00e9marches administratives deviennent toujours plus complexes et la fluctuation actuelle des taux d\u2019int\u00e9r\u00eats hypoth\u00e9caires ne la rassure pas. Autre probl\u00e8me, deux appartements ont \u00e9t\u00e9 lib\u00e9r\u00e9s par leurs locataires qui ont r\u00e9sili\u00e9 leur contrat de bail dans le d\u00e9lai contractuel. Or, ces logements, n\u2019ont pas subi de r\u00e9novation depuis de nombreuses ann\u00e9es et n\u00e9cessitent d\u2019importants travaux dont, notamment, l\u2019am\u00e9nagement d\u2019une nouvelle cuisine et d\u2019une salle de bains.<\/p>\n<p>Jeanne a pens\u00e9 vendre cet immeuble pour ne plus avoir de soucis administratifs et financiers. Mais elle a appris, par des connaissances, qu\u2019il existait maintenant une solution qui lui permettrait de vendre son bien tout en conservant la propri\u00e9t\u00e9 de son terrain. Le nouveau propri\u00e9taire assumera ainsi toutes les charges et l\u2019exploitation de l\u2019immeuble. Quant \u00e0 Jeanne, elle touchera imm\u00e9diatement en esp\u00e8ces la valeur de march\u00e9 de l\u2019immeuble, qu\u2019il est conseill\u00e9 de d\u00e9terminer par une expertise, conservera le terrain qui supporte l\u2019immeuble et percevra une rente sans aucune contrainte, vers\u00e9e mensuellement ou annuellement.<\/p>\n<p><strong>Le droit de superficie<\/strong><\/p>\n<p>Evidemment, cette solution n\u00e9cessitera la signature d\u2019un acte authentique devant notaire qui comportera la vente de l\u2019immeuble soit de la construction \u00e0 sa valeur v\u00e9nale ainsi que la constitution d\u2019une servitude de superficie qui conf\u00e9rera \u00e0 l\u2019acheteur le droit de maintenir l\u2019immeuble sur le terrain. Si la servitude a le caract\u00e8re d\u2019un droit distinct et permanent, ce qui est pr\u00e9cis\u00e9ment le cas dans notre exemple, il pourra \u00eatre immatricul\u00e9 comme immeuble au sens juridique du terme au Registre foncier, c\u2019est-\u00e0-dire qu\u2019il sera enregistr\u00e9 comme une parcelle avec un num\u00e9ro et toutes les inscriptions habituelles telles que, notamment, la surface de la construction avec son num\u00e9ro d\u2019assurance-incendie, le nom du propri\u00e9taire de la construction ainsi que tous les droits et charges pouvant grever une parcelle.<\/p>\n<p>Le droit de superficie permet ainsi de dissocier la propri\u00e9t\u00e9 du terrain de celle de la construction \u00e9rig\u00e9e sur ce dernier au moment de sa constitution ou de la construction qui pourrait \u00eatre \u00e9difi\u00e9e par la suite. Il ne peut pas \u00eatre constitu\u00e9 pour plus de cent ans comme droit distinct. Il peut \u00eatre prolong\u00e9 en tout temps pour une nouvelle dur\u00e9e maximum de cent ans, mais tout engagement pris d\u2019avance \u00e0 ce sujet est nul. A l\u2019expiration du droit de superficie, la construction fait retour au propri\u00e9taire du terrain, contre le versement d\u2019une indemnit\u00e9, et redevient partie int\u00e9grante de ce terrain.<\/p>\n<p><strong>Avantages<\/strong><\/p>\n<p>Par la m\u00e9thode expos\u00e9e ci-dessus, Jeanne pourra toucher imm\u00e9diatement la valeur de march\u00e9 de son b\u00e2timent, conserver la propri\u00e9t\u00e9 du terrain supportant le b\u00e2timent vendu et \u00eatre lib\u00e9r\u00e9e de tous soucis et contraintes.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\"
