Naturellement, je lui propose de lui c\u00e9der une partie du terrain situ\u00e9 en zone \u00e0 b\u00e2tir, pour qu\u2019il construise et s\u2019installe avec sa petite famille. Ce terrain a \u00e9t\u00e9 acquis vingt ans auparavant du p\u00e8re du voisin actuel.<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-kpjmfgil-ca1b4bc97ca6bed109f28ea6b1675123 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p style=\"text-align: justify;\">La parcelle c\u00e9d\u00e9e est grev\u00e9e, comme celles alentour, encore propri\u00e9t\u00e9 du voisin, d\u2019une servitude \u00abd\u2019interdiction de b\u00e2tir un b\u00e2timent de plus d\u2019un \u00e9tage sous l\u2019avant-toit\u00bb en faveur de la parcelle sur laquelle ledit voisin a son habitation. Sur les parcelles alentour, le voisin a construit des petits immeubles de rendement d\u00e9passant de deux \u00e9tages la limite de ladite servitude. Cette servitude a \u00e9t\u00e9 inscrite en 1966 par le p\u00e8re du voisin actuel. J\u2019en conclus que la servitude a perdu tout int\u00e9r\u00eat. Je me dis \u00e9galement que la proc\u00e9dure de mise \u00e0 l\u2019enqu\u00eate publique a pour but de faire valoir ces diff\u00e9rents droits, le cas \u00e9ch\u00e9ant.<\/p>\n<p style=\"text-align: justify;\">Le temps passe et le projet de mon fils prend forme. La mise \u00e0 l\u2019enqu\u00eate publique arrive \u00e0 son terme et aucune opposition n\u2019a \u00e9t\u00e9 d\u00e9pos\u00e9e. Je pense alors que le voisin n\u2019a rien \u00e0 redire du projet et que ses droits ne sont pas l\u00e9s\u00e9s. Les premiers travaux commencent. C\u2019est \u00e0 ce moment pr\u00e9cis que mon fils se voit notifier une d\u00e9cision sur mesures superprovisionnelles d\u2019arr\u00eat des travaux de la part du voisin, arguant de la violation de la servitude d\u2019interdiction de b\u00e2tir, la construction projet\u00e9e d\u00e9passant la limite fix\u00e9e par la servitude. Quels sont les moyens \u00e0 ma disposition?<\/p>\n<p style=\"text-align: justify;\">LA CONVENTION. En parall\u00e8le \u00e0 la proc\u00e9dure judiciaire, il est possible de trouver un accord avec le voisin, qui, contre un d\u00e9dommagement financier, acceptera de radier ladite servitude, d\u2019abandonner la proc\u00e9dure judiciaire et de permettre ainsi la construction. Il n\u2019existe pas de m\u00e9thode de calcul de la valeur v\u00e9nale de la servitude. La renonciation \u00e0 celle-ci est fix\u00e9e d\u2019entente entre les parties. Cette solution est la plus rapide. Toutefois, elle peut faire na\u00eetre un sentiment d\u2019injustice. Pourquoi payer pour une servitude qui aurait perdu toute utilit\u00e9? Le notaire peut aider les parties \u00e0 r\u00e9diger une telle convention.<\/p>\n<p style=\"text-align: justify;\">LA LIB\u00c9RATION JUDICIAIRE. C\u2019est la voie la plus longue n\u00e9cessitant de s\u2019attacher les services d\u2019un avocat, et dont l\u2019issue reste incertaine. L\u2019article 736 du Code civil suisse pr\u00e9voit qu\u2019une servitude ayant perdu toute utilit\u00e9 peut \u00eatre radi\u00e9e ou, si cette utilit\u00e9 est r\u00e9duite, la radiation aura lieu contre indemnit\u00e9. En l\u2019esp\u00e8ce, on serait tent\u00e9 de dire que la servitude d\u2019interdiction de b\u00e2tir a perdu toute utilit\u00e9 pour le voisin, ce dernier ayant lui-m\u00eame d\u00e9pass\u00e9 les limites de construction sur ses propres fonds. Il faut \u00eatre prudent avec ce raisonnement, car le tribunal utilisera plusieurs canaux d\u2019interpr\u00e9tation, afin de mesurer l\u2019utilit\u00e9 d\u2019une servitude.<\/p>\n<p style=\"text-align: justify;\">Dans un cas similaire, pour une servitude inscrite en 1948, la jurisprudence a jug\u00e9 que la densification du quartier et le d\u00e9veloppement du droit de l\u2019am\u00e9nagement du territoire ne suffisent pas, \u00e0 eux seuls, \u00e0 d\u00e9terminer que la servitude n\u2019aurait plus d\u2019utilit\u00e9. Il faut encore que la servitude ait pour cons\u00e9quence d\u2019emp\u00eacher toute utilisation rationnelle de l\u2019immeuble sur lequel est inscrit la servitude, ce qui n\u2019est pas le cas, puisque le propri\u00e9taire en question a toujours la possibilit\u00e9 de construire une villa.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
