Le vendeur est tenu de garantir l\u2019acheteur tant en raison des qualit\u00e9s promises qu\u2019en raison des d\u00e9fauts de l\u2019immeuble. Il r\u00e9pond de ces d\u00e9fauts m\u00eame s\u2019il les ignorait.<\/p>\n<p style=\"text-align: justify;\">Cependant, la plupart des contrats de vente immobili\u00e8re pr\u00e9voient une clause limitant ou excluant une telle responsabilit\u00e9, sauf en cas de dissimulation frauduleuse. L\u2019hypoth\u00e8se de la dissimulation frauduleuse est notamment r\u00e9alis\u00e9e lorsque le vendeur omet d\u2019aviser son cocontractant d\u2019un d\u00e9faut dont il avait pourtant connaissance.<\/p>\n<p style=\"text-align: justify;\">Il est \u00e9galement fondamental pour un acheteur \u00e9ventuel de retenir qu\u2019il a, de par la loi, un devoir de v\u00e9rifier l\u2019\u00e9tat de l\u2019immeuble aussit\u00f4t qu\u2019il le peut et d\u2019aviser sans d\u00e9lai le vendeur s\u2019il d\u00e9couvre un d\u00e9faut dont ce dernier est garanti. Le d\u00e9lai d\u2019annonce, de sept \u00e0 dix jours \u00e0 compter de la d\u00e9couverte du d\u00e9faut, est tr\u00e8s court et les cons\u00e9quences d\u2019une l\u00e9g\u00e8ret\u00e9 dans son respect peuvent \u00eatre lourdes. A d\u00e9faut de les exercer en temps utiles, l\u2019acheteur perd en effet purement et simplement ses droits de garantie, et le vendeur est lib\u00e9r\u00e9 de toute responsabilit\u00e9.<\/p>\n<p style=\"text-align: justify;\">Enfin, l\u2019acheteur doit garder \u00e0 l\u2019esprit le d\u00e9lai de prescription pour l\u2019action en garantie des d\u00e9fauts. Celui-ci est en principe de cinq ans \u00e0 compter de la livraison, lorsque des \u00e9l\u00e9ments int\u00e9gr\u00e9s \u00e0 l\u2019ouvrage immobilier sont \u00e0 l\u2019origine d\u2019un dommage.<\/p>\n<p style=\"text-align: justify;\">L\u2019acheteur et le vendeur peuvent conventionnellement r\u00e9server un d\u00e9lai plus long. Un d\u00e9lai plus court peut aussi \u00eatre pr\u00e9vu, mais \u00e0 des conditions restrictives.
