Son principe: interdire la construction de nouvelles r\u00e9sidences secondaires dans les communes suisses ayant un taux de r\u00e9sidences secondaires sup\u00e9rieur \u00e0 20%. Dans les faits, la diversit\u00e9 des situations qu\u2019elle doit r\u00e9gir rend son application relativement complexe. Quelques exemples.<\/p>\n<p style=\"text-align: justify;\"><strong>L\u2019APPARTEMENT DE HANS<\/strong><\/p>\n<p style=\"text-align: justify;\">Hans veut vendre un appartement \u00e0 Anz\u00e8re (VS), achet\u00e9 en 1995. L\u2019acheteur lui demande si ce dernier a un statut de r\u00e9sidence secondaire. L\u2019extrait du Registre foncier ne l\u2019indique pas. Est-ce grave?<\/p>\n<p style=\"text-align: justify;\">Non, c\u2019est normal. S\u2019agissant d\u2019un logement construit avant le 11 mars 2012, la LRS pr\u00e9voit qu\u2019il peut \u00eatre utilis\u00e9 librement comme r\u00e9sidence principale ou r\u00e9sidence secondaire. M\u00eame si l\u2019appartement est lou\u00e9 \u00e0 une personne qui l\u2019occupe \u00e0 l\u2019ann\u00e9e, Hans peut le revendre comme logement de vacances. Attention toutefois: le droit communal ou cantonal peut pr\u00e9voir des restrictions \u00e0 ce principe.<\/p>\n<p style=\"text-align: justify;\"><strong>LE CHALET DE CLAUDIA<\/strong><\/p>\n<p style=\"text-align: justify;\">Claudia veut agrandir son chalet, \u00e0 Leysin (VD). Elle a entendu dire qu\u2019elle ne pourrait pas le faire, \u00e0 moins d\u2019y vivre \u00e0 l\u2019ann\u00e9e. Est-ce exact?<\/p>\n<p style=\"text-align: justify;\">Heureusement pas. La LRS pr\u00e9voit la possibilit\u00e9 d\u2019agrandir un chalet de vacances. Cependant, l\u2019agrandissement est limit\u00e9 \u00e0 un maximum de 30% de la surface existante. Claudia devra \u00eatre prudente: si elle d\u00e9passe ce seuil, son chalet ne pourra pas conserver un statut de r\u00e9sidence secondaire.<\/p>\n<p style=\"text-align: justify;\"><strong>UN TERRAIN ENCOMBRANT<\/strong><\/p>\n<p style=\"text-align: justify;\">Thomas vient d\u2019h\u00e9riter d\u2019une parcelle \u00e0 Crans-Montana (VS). Il a d\u00e9cid\u00e9 d\u2019y \u00e9difier un immeuble de rapport (NDLR qui sous-entend un rapport sur investissement). Est-ce encore possible?<\/p>\n<p style=\"text-align: justify;\">Cela d\u00e9pend de l\u2019affectation des locaux. Si Thomas souhaite construire des appartements servant \u00e0 la r\u00e9sidence secondaire, c\u2019est non.<\/p>\n<p style=\"text-align: justify;\">On pourrait penser que, a contrario, la construction d\u2019appartements utilis\u00e9s comme r\u00e9sidences principales, par des habitants \u00e0 l\u2019ann\u00e9e (par exemple des locataires travaillant dans la station), serait autoris\u00e9e sans difficult\u00e9&#8230; Pas si simple! Selon la jurisprudence r\u00e9cente du Tribunal f\u00e9d\u00e9ral, Thomas ne pourra construire des r\u00e9sidences principales que s\u2019il d\u00e9montre qu\u2019il existe, \u00e0 ce jour, un d\u00e9ficit de logements dans la r\u00e9gion pour des personnes souhaitant y r\u00e9sider \u00e0 l\u2019ann\u00e9e. Pour cela, il faudra notamment \u00e9tablir la proportion de r\u00e9sidences principales d\u00e9j\u00e0 existantes et inoccup\u00e9es, et d\u00e9montrer qu\u2019il existe une demande pour la construction de nouvelles r\u00e9sidences principales (par exemple en signant des contrats de r\u00e9servation avec des acheteurs ou des locataires int\u00e9ress\u00e9s par le projet). En pratique, ces preuves sont difficiles \u00e0 apporter.<\/p>\n<p style=\"text-align: justify;\">Enfin, si Thomas ne souhaite pas construire des logements, il peut d\u00e9cider d\u2019\u00e9difier un b\u00e2timent h\u00e9bergeant une activit\u00e9 commerciale, comme des bureaux ou un h\u00f4tel. A noter que des appartements occup\u00e9s cent jours par an par des touristes, et utilis\u00e9s le reste du temps par leurs propri\u00e9taires comme r\u00e9sidences secondaires, n\u2019entrent pas
