Que faire?<\/h2><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div><br \/>\n<section  class='av_textblock_section av-kpji3sqd-97117d3eeba9492e7f791d34ada42dbe '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p style=\"text-align: justify;\">J\u2019ai h\u00e9rit\u00e9 d\u2019une parcelle situ\u00e9e en zone \u00e0 b\u00e2tir. Ma fille, qui a fond\u00e9 une famille, souhaite construire, sur ce terrain, une maison familiale. Je me suis dit: \u00abPas de souci, je contacte le notaire pour transf\u00e9rer la propri\u00e9t\u00e9 de la parcelle en faveur de ma fille sous forme de donation et le tour est jou\u00e9.\u00bb J\u2019\u00e9tais loin de penser que j\u2019\u00e9tais sur le point de plonger ma fille et sa petite famille dans les m\u00e9andres du droit et des relations de voisinage \u00e9pineuses.<\/p>\n<p style=\"text-align: justify;\">En fait, le fameux terrain dispose d\u2019un simple acc\u00e8s pour pi\u00e9tons, soit un chemin pierreux d\u2019une largeur de moins de deux m\u00e8tres, qui passe sur les parcelles voisines. Ce chemin est visible sur geoportail sous \u00abortho photo\u00bb. Il est connu de tout le voisinage. Mais je ne b\u00e9n\u00e9ficie d\u2019aucune servitude en ce sens que le Registre foncier n\u2019indique strictement rien \u00e0 ce sujet.<\/p>\n<p style=\"text-align: justify;\">Or, pour b\u00e2tir une maison familiale, il faut bien que les artisans puissent acc\u00e9der \u00e0 la parcelle depuis la route cantonale. Et, par la suite, il faut bien que les propri\u00e9taires de la maison et leurs invit\u00e9s puissent y acc\u00e9der. Que faire?<\/p>\n<p style=\"text-align: justify;\"><strong>UN ACCORD \u00c0 L\u2019AMIABLE?<\/strong><\/p>\n<p style=\"text-align: justify;\">J\u2019ai contact\u00e9 mon notaire qui m\u2019a donn\u00e9 la marche \u00e0 suivre. Dans un tout premier \u00e9lan, il faut approcher les propri\u00e9taires des parcelles voisines sur lesquelles passe le chemin pierreux et leur exposer la situation aux fins d\u2019obtenir leur accord pour constituer une servitude de droit de passage \u00e0 pied et pour tout v\u00e9hicule sur le trac\u00e9 pr\u00e9existant du chemin pierreux. Avec l\u2019accord de tous les propri\u00e9taires, le g\u00e9om\u00e8tre \u00e9tablit un plan de servitude. Ledit plan est transmis \u00e0 un notaire qui r\u00e9digera un projet d\u2019acte authentique, lequel projet sera soumis aux parties (le b\u00e9n\u00e9ficiaire de la servitude, soit le propri\u00e9taire de la parcelle \u00e0 laquelle la servitude de passage permet l\u2019acc\u00e8s, et les propri\u00e9taires des parcelles sur lesquelles passe la servitude). C\u2019est la solution id\u00e9ale.<\/p>\n<p style=\"text-align: justify;\"><strong>EN CAS DE REFUS<\/strong><\/p>\n<p style=\"text-align: justify;\">En cas de refus des propri\u00e9taires voisins, il convient de dire le droit et de leur communiquer la teneur de l\u2019article 694 al. 1 du Code civil suisse (CC) qui pr\u00e9cise ce qui suit: \u00abLe propri\u00e9taire qui n\u2019a qu\u2019une issue insuffisante sur la voie publique peut exiger de ses voisins qu\u2019ils lui c\u00e8dent le passage n\u00e9cessaire, moyennant pleine indemnit\u00e9. Une route priv\u00e9e grev\u00e9e de droits de passage n\u2019a pas de valeur v\u00e9nale et ne donne donc pas lieu \u00e0 une indemnit\u00e9.\u00bb\u00a0 DEMANDE EN JUSTICE<\/p>\n<p style=\"text-align: justify;\">Dans l\u2019hypoth\u00e8se o\u00f9 les voisins persistent dans leur refus, je serai contraint d\u2019agir en justice. Pour ce faire, il m\u2019a \u00e9t\u00e9 vivement conseill\u00e9 de mandater un avocat \u2014 le notaire n\u2019est, en effet, pas habilit\u00e9 \u00e0 proc\u00e9der en justice dans un tel cas litigieux \u2014 pour faire valoir mes droits.<\/p>\n<\/div><\/section><\/p><\/div>\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
