Le propri\u00e9taire peut en disposer seul, librement. Cette forme de propri\u00e9t\u00e9 s\u2019oppose \u00e0 la propri\u00e9t\u00e9 collective qui pr\u00e9voit que le droit de propri\u00e9t\u00e9 sur un bien est partag\u00e9 entre plusieurs personnes.<\/p>\n<p style=\"text-align: justify;\">La propri\u00e9t\u00e9 collective peut prendre elle-m\u00eame la forme de la copropri\u00e9t\u00e9 ou de la propri\u00e9t\u00e9 commune. Comment distinguer ces deux r\u00e9gimes, et quelles sont les r\u00e8gles applicables \u00e0 chacun d\u2019eux?<\/p>\n<p style=\"text-align: justify;\">Prenons l\u2019exemple d\u2019un fr\u00e8re et de sa s\u0153ur propri\u00e9taires d\u2019un bien immobilier. La s\u0153ur d\u00e9sire vendre \u00absa part\u00bb. Peut-elle la vendre sans restriction? Cela d\u00e9pend du r\u00e9gime de propri\u00e9t\u00e9 auquel ils sont soumis.<\/p>\n<p style=\"text-align: justify;\"><strong>En cas de copropri\u00e9t\u00e9<\/strong><br \/>\nLe r\u00e9gime de la copropri\u00e9t\u00e9 pr\u00e9voit que plusieurs personnes partagent un droit de propri\u00e9t\u00e9 sur un bien d\u00e9termin\u00e9. Chacun d\u00e9tient une quote-part \u00abid\u00e9ale\u00bb sur le bien, car celui-ci n\u2019est pas mat\u00e9riellement divis\u00e9. Le copropri\u00e9taire peut disposer librement de sa quotepart, comme, par exemple, la vendre, la donner, etc. Le l\u00e9gislateur a n\u00e9anmoins pr\u00e9vu que, en cas de vente d\u2019une quote-part d\u2019un bien immobilier, les autres copropri\u00e9taires pouvaient exercer un droit de pr\u00e9emption l\u00e9gal, soit un droit d\u2019achat prioritaire sur tout tiers acqu\u00e9reur, afin notamment d\u2019\u00e9viter qu\u2019une personne tierce n\u2019entre dans la communaut\u00e9 des copropri\u00e9taires. La s\u0153ur pourra donc vendre sa part, mais en la proposant pr\u00e9alablement \u00e0 son fr\u00e8re, qui n\u2019a pas l\u2019obligation de l\u2019acqu\u00e9rir.<\/p>\n<p style=\"text-align: justify;\"><strong>En cas de propri\u00e9t\u00e9 commune<\/strong><br \/>\nEn cas de propri\u00e9t\u00e9 commune, les propri\u00e9taires du bien forment ensemble une communaut\u00e9, chacun des membres poss\u00e9dant un droit de propri\u00e9t\u00e9 s\u2019\u00e9tendant \u00e0 la chose en son entier. Contrairement \u00e0 la copropri\u00e9t\u00e9, un rapport juridique doit exister pr\u00e9alablement entre les membres de la communaut\u00e9. Soit ce lien existe de par la loi (hoirie), soit sur la base d\u2019un contrat (contrat de mariage entre \u00e9poux en communaut\u00e9 de biens, contrat de soci\u00e9t\u00e9 simple, etc.). Les membres de la communaut\u00e9 exercent leur droit de propri\u00e9t\u00e9 en accord avec les autres membres, et toutes les d\u00e9cisions doivent \u00eatre prises \u00e0 l\u2019unanimit\u00e9. Cette forme de propri\u00e9t\u00e9 rend impossible, pour un membre de la communaut\u00e9, de disposer librement d\u2019une quotepart du bien.<\/p>\n<p style=\"text-align: justify;\">Comme indiqu\u00e9 ci-dessus, une hoirie fait partie du r\u00e9gime de la propri\u00e9t\u00e9 collective. Elle d\u00e9signe la communaut\u00e9 form\u00e9e par l\u2019ensemble des h\u00e9ritiers d\u2019un d\u00e9funt appel\u00e9e \u00abcommunaut\u00e9 h\u00e9r\u00e9ditaire\u00bb qui na\u00eet de par le d\u00e9c\u00e8s du d\u00e9funt. Les h\u00e9ritiers deviennent propri\u00e9taires en mains communes de l\u2019ensemble du patrimoine du d\u00e9funt, aussi longtemps qu\u2019un partage successoral n\u2019est pas intervenu. Ils administrent ensemble le patrimoine successoral, et toutes les d\u00e9cisions doivent \u00eatre prises \u00e0 l\u2019unanimit\u00e9.<\/p>\n<p style=\"text-align: justify;\">Si le fr\u00e8re et la s\u0153ur d\u00e9tiennent le bien immobilier en propri\u00e9t\u00e9 commune, cette derni\u00e8re ne sera pas libre de vendre individuellement sa part. Lors d\u2019un achat immobilier, vous devez vous demander sous quelle forme de propri\u00e9t\u00e9 vous voulez acqu\u00e9rir: une soci\u00e9t\u00e9 simple ou une copropri\u00e9t\u00e9 ordinaire? Et comment choisir? Cela d\u00e9pendra de votre situation: mari\u00e9s, concubins, associ\u00e9s professionnellement?
